These Terms of Service ("Terms") govern your use of this website and the services provided by Flat Roof Waterproofing Solutions ("Company," "we," "our," or "us"). By requesting an inspection or estimate, scheduling services, or engaging us for any work, you agree to be bound by these Terms.

1. Services

Flat Roof Waterproofing Solutions provides commercial flat roof waterproofing, inspection, repair, coating, restoration, and related roofing services. The scope of any specific project is defined in a written proposal or contract provided to you before work begins. Inspection reports and preliminary estimates, including any range produced by the online estimator on this website, are for budgeting purposes only and do not constitute a contract or a firm price.

2. Estimates and Pricing

Firm pricing is issued only after an on-roof inspection. Written estimates are valid for 30 days from the date of issuance unless otherwise noted. Prices are subject to change based on material costs, scope changes, or site conditions discovered during the course of work, including wet insulation or deck deterioration not visible before the roof is opened. Any change to scope will be communicated in writing and approved by you before additional work is performed.

3. Payment Terms

Payment terms are set out in your service agreement or invoice. Unless otherwise agreed in writing, a deposit may be required before work begins, final payment is due upon completion, and invoices not paid within 30 days may be subject to a late fee. We accept payment by check, credit card, and electronic transfer. Returned checks are subject to a returned check fee.

4. Text Message Communications and Consent

By providing a mobile phone number and opting in on our contact form or service agreement, you consent to receive text messages from Flat Roof Waterproofing Solutions at the number provided, including appointment confirmations, project status updates, estimates, and invoices. Message and data rates may apply. Message frequency will vary. You may opt out at any time by replying STOP. Consent to receive text messages is not a condition of purchasing our services. We will not share your mobile number or consent with third parties for their own marketing purposes.

5. Warranties

Warranty terms specific to your project, including duration, coverage, and whether the warranty is issued by the Company or by the system manufacturer, are detailed in your written service agreement and warranty certificate. Warranties do not cover damage caused by acts of nature, storms, or extreme weather events; modifications or repairs made by the customer or unauthorized third parties after project completion; pre-existing structural conditions not disclosed or not discoverable at the time of service; or normal wear beyond the warranty period. Transfer of a manufacturer warranty to a new building owner is subject to the manufacturer's procedures.

6. Cancellations and Rescheduling

Please notify us as soon as possible if you need to cancel or reschedule. Cancellations made with less than 24 hours' notice for scheduled work may be subject to a cancellation fee. Deposits may be non-refundable if materials have been ordered or work has commenced.

7. Access to Property

You agree to provide safe and reasonable roof and site access for our team to perform the requested services, including staging areas and, where applicable, after-hours access. You are responsible for removing or protecting property in the work area and beneath active work zones before service. We are not responsible for damage to property that was not cleared from or protected in the work area.

8. Insurance

We maintain commercial general liability and workers' compensation coverage and will provide a certificate of insurance, including additional insured endorsements where required, on request before work begins.

9. Limitation of Liability

To the fullest extent permitted by applicable law, the total liability of Flat Roof Waterproofing Solutions to you for any claims arising out of or related to our services shall not exceed the total amount paid by you for the services giving rise to the claim. In no event shall we be liable for indirect, incidental, consequential, or punitive damages, including loss of business or tenant income.

10. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes shall be submitted to mediation before pursuing litigation. These Terms are governed by the laws of the State of Michigan.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our services following any update constitutes your acceptance of the revised Terms.
